Terms of Service

These Terms of Service ("Terms") govern your access to and use of Buzzfy (the "Service"), offered at buzzfy.co. In these Terms, "Company", "we", "us" and "our" mean the provider of the Service, and "Authorised Reseller" means the seller of web purchases, both identified in Section 16. "User" or "you" means the person using the Service. "Buzzfy" is the brand and application name under which the Service is offered and has no separate legal personality.

1. The Service

Buzzfy is a subscription-based software platform that connects to your Instagram account to automatically generate video variants of your existing Reels, publish them as Instagram Trial Reels, and track their performance. The Service uses AI-powered analysis to identify and test improvements to your content. The Service also lets you connect third-party AI apps to your Buzzfy account, so they can read your Instagram data and, on a paid plan, act on your account after you approve (Section 5).

1.1 Instagram and Meta

Buzzfy uses Instagram's official API. Buzzfy is independent and is not affiliated with, sponsored or endorsed by Meta. Instagram and Meta are trademarks of Meta Platforms, Inc.

2. Eligibility

You must be at least 18 years old to use the Service. By using Buzzfy, you represent that you have the legal authority to enter into these Terms and to grant us access to any Instagram account you connect.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at support@buzzfy.co if you suspect unauthorized access.

4. Instagram Account Connection

By connecting your Instagram account to Buzzfy, you authorize us to:

  • Access your existing Reels and account metadata
  • Publish Trial Reels to your account on your behalf
  • Read performance insights (reach, views, engagement) for Reels we publish
  • If you use an AI app with Buzzfy (Section 5), read your account statistics, audience insights, posts, comments and direct messages, and carry out the actions you approve: publishing or scheduling posts, replying to comments, sending direct messages, hiding, unhiding, deleting or liking comments, turning comments on or off, and managing comment-to-DM automations

You may revoke this access at any time via your account settings or through Instagram's app settings. You are solely responsible for ensuring your use of Buzzfy complies with Instagram's Terms of Use and Community Guidelines. How your data is processed, and by whom, is set out in our Privacy Policy.

5. AI Apps and the Buzzfy MCP

5.1 What It Is

Buzzfy's MCP server lets an AI app you choose (for example Claude, ChatGPT, Cursor, Codex or Grok) use Buzzfy's tools for your account. You connect an app by signing in to Buzzfy from it and approving access on Buzzfy's consent screen. You may connect only apps you are entitled to use, and only to a Buzzfy account and Instagram account you control. You can see and disconnect the AI apps connected to your account in Settings > Connected AI apps.

5.2 The AI App Acts for You

A connected AI app acts on your instructions and on your behalf. What it does with your Buzzfy account is treated as done by you. That includes actions an app takes because of something it read, such as text in a comment or message. You are responsible for the instructions you give the app and for the settings you choose in it.

5.3 Actions Happen Only After a Preview

Tools that change something on your Instagram account are: publishing or scheduling posts, changing or cancelling scheduled posts, replying to comments, sending direct messages, hiding, unhiding, deleting or liking comments, turning comments on or off, and creating, changing, pausing or deleting automations. Each works in two steps. First, Buzzfy gives the AI app a preview of exactly what will happen, with a one-time code that expires after about 10 minutes. Buzzfy tells the app to show you the preview and wait for your approval. Buzzfy carries out the action only when the app returns that code, with nothing changed, and only once.

Buzzfy can't see your conversation with the AI app, so it can't confirm that the app actually showed you the preview or asked you. Please review each preview before you approve it, and use the approval settings your AI app offers. You are responsible for every action you approve, or that your AI app confirms for you, including content published, messages sent and comments deleted. Some actions can't be undone through Buzzfy, such as deleting a comment or sending a message.

Scheduled posts are published in the background at the time you chose, as long as your plan and Instagram connection are still active then. Automations keep running until you pause or delete them. Disconnecting the AI app doesn't cancel either one.

5.4 Your Content and Instagram's Rules

You are responsible for the content you publish or send through an AI app, and for making sure it, and your use of the MCP, complies with Instagram's Terms of Use, Community Guidelines and Platform policies, and with applicable law. That includes rules on spam, messaging, and the privacy of the people whose comments and messages you read. Instagram's own limits still apply, for example when you may reply to a direct message. Section 8 (Acceptable Use) applies in full.

5.5 Third-Party AI Apps

AI apps are provided by third parties under their own terms and privacy policies. Buzzfy doesn't provide, control or check them. We are not responsible for what an AI app says or does, for the accuracy of its outputs, summaries or advice, or for how it stores, uses or shares data it receives from Buzzfy. How Buzzfy handles data for AI apps is described in our Privacy Policy.

5.6 Plans and Accounts Created from an AI App

Reading your Instagram data through an AI app is available on any Buzzfy account with Instagram connected. Actions that change your account, uploads for publishing and viewing scheduled posts need an active paid plan (Standard, Pro or MAX). A free trial doesn't count. Automations need the MAX plan. Plan features may change as described in Section 15.

Searching the Reel library is available on any Buzzfy account within a daily limit (10 a day free, 30 on Standard or Pro, 100 on MAX); full reel details need an active paid plan, and finding similar reels needs MAX.

You can create a Buzzfy account through a supported AI assistant connected to Buzzfy through our MCP connector (for example Claude, ChatGPT, Cursor or Grok). You enter your email address on a Buzzfy page, not in the assistant. These accounts get the same free trial as accounts created on our website. The free trial does not require a payment card and does not turn into a paid subscription automatically. You are only charged if you choose a paid plan, and we show you the price, renewal terms and how to cancel before you confirm it. Buzzfy does not post anything to your Instagram account, including Trial Reels (short videos Buzzfy creates for you during the trial), until you switch this on. You can switch it off at any time.

5.7 Limits, Suspension and Changes

To protect your Instagram account, Buzzfy and other users, we limit how much each account can use the MCP. Current limits are shown at buzzfy.co/mcp/tools. Instagram also applies its own limits. We may, without notice, suspend or restrict MCP access, stop some or all actions for one account or for everyone, or pause automations created through an AI app, if we reasonably believe it is needed to prevent abuse, protect the Service or your Instagram account, comply with Instagram's policies or the law, or fix a problem. We may add, change or remove MCP tools at any time.

5.8 Availability

The MCP and its tools are provided "as is" and "as available", as described in Section 11. They depend on AI apps and on Instagram's API, which we don't control. They may be unavailable, return incomplete data, or behave differently between AI apps.

Reel Search shows Reels made and owned by other creators. You may use results for inspiration and research only. You get no right to download, re-upload, copy or republish another creator's Reel, words or likeness, and the Acceptable Use rules in Section 8 apply. Ratings are Buzzfy's estimates, not guarantees. Daily limits depend on your plan and are shown at buzzfy.co/mcp/tools.

6. Free Trial

We offer a free trial period upon signup. No credit card is required to start a trial. Trial length varies depending on the signup method (organic signups receive 3 days; users who sign up with a valid invite code receive the trial length associated with that code). Accounts created through an AI assistant get the same free trial, on the same terms (Section 5.6).

After the trial expires, your account will be paused and no new Trial Reels will be published until you subscribe. Previously published Trial Reels on Instagram are not deleted. A free trial never turns into a paid plan by itself.

7. Subscriptions and Payment

a) Plans

Buzzfy is sold in three tiers: Standard, Pro and MAX. Each tier can be billed weekly, every 4 weeks, every 12 weeks, monthly, every 3 months, every 6 months or yearly. Which billing periods you can pick depends on the offer you see at checkout. Current pricing is displayed on our website at buzzfy.co/pricing and within the Service at the time of purchase. Prices are in USD and may vary based on promotional offers, invite codes, or campaigns. Any personalized offer communicated to you (e.g., via email or invite code) will reflect the terms applicable to that offer.

b) Automatic Renewal

Your plan renews automatically at the end of each billing period until you cancel. Some plans start with a discounted first period; after it ends, the plan renews at the regular price and billing period shown at checkout. Before you pay, the checkout shows the amount charged today, the renewal price, the billing period and how to cancel, and asks you to agree to automatic renewal. After purchase we email you a confirmation with these details. Where the law requires it, we send you a reminder before a plan with a billing period of one year renews.

If you buy an upgrade after checkout (for example from Standard to Pro or MAX), it is charged to the card on file, and it changes the price your plan renews at.

c) Billing

Web purchases are sold and charged by the Authorised Reseller as merchant of record and processed through its payment processor, Stripe. By subscribing, you authorize the Authorised Reseller to charge your payment method on a recurring basis, once per billing period, until you cancel. Prices are in USD. Applicable taxes may be added at checkout depending on your location.

d) Trial-to-Paid Discount

We may offer a discounted rate on certain plans exclusively during your free trial period. Any such discount is communicated to you within the Service or via email, expires when your trial expires, and cannot be applied retroactively.

e) Cancellation

You may cancel your subscription at any time online, with the "Cancel subscription" button in Billing in your dashboard, without contacting us. We confirm the cancellation on screen and by email. Your access continues until the end of the period you have paid for, and the plan does not renew. Apart from the refunds in sections (f) and (g), we do not offer prorated refunds for partial billing periods.

f) Refunds

We offer a money-back guarantee on subscriptions. If you ask for a refund within 7 days of a subscription charge, that charge is refunded in full. After 7 days, subscription charges are not refundable, except where the law requires it.

One-time purchases, such as the Viral Reels Playbook, are final once delivered, except where the law requires a refund.

To ask for a refund, email support@buzzfy.co from the address on your account. Refunds of web purchases are paid by the Authorised Reseller to the original payment method. More detail is in our Refund and Cancellation Policy.

g) Right of Withdrawal (consumers in the EU, EEA and UK)

If you are a consumer resident in the European Union, the European Economic Area or the United Kingdom, you may withdraw from a paid subscription within 14 days of the day you bought it, without giving a reason, by emailing support@buzzfy.co or using any clear statement. At checkout you ask us to start the Service immediately. If you then withdraw within 14 days, you receive a refund of the amount paid minus a proportionate amount for the days of service you received up to your withdrawal; if you withdraw within 7 days, the money-back guarantee in section (f) applies and the charge is refunded in full. Refunds are made within 14 days of your withdrawal, to the original payment method.

8. Acceptable Use

You agree not to:

  • Use the Service to post content that violates Instagram's Terms of Use, Community Guidelines, or any applicable law
  • Use the Service to publish spam, misleading content, or inauthentic engagement
  • Attempt to reverse engineer, decompile, or copy any part of the Service
  • Share your account credentials with others or use the Service on behalf of multiple Instagram accounts unless explicitly permitted
  • Interfere with or disrupt the integrity or performance of the Service
  • Use an AI app with Buzzfy to send unsolicited, bulk or automated messages or replies, or to collect other people's data beyond what you need to manage your own account, other than through Reel Search, within its limits
  • Use Reel Search to bulk-export the library, to build a competing dataset, or to contact or harass creators
  • Get around the Service's usage limits or preview-and-approval steps, or use the MCP in a way meant to exceed Instagram's limits
  • Connect Buzzfy to an app that misleads users about its identity or collects their Buzzfy access without their informed consent
  • Use the Service for any unlawful purpose

9. Content and Intellectual Property

You retain ownership of all content you bring to the Service, including your original Reels. By using the Service, you grant the Company a limited, non-exclusive, worldwide, royalty-free license to access, process, modify (for variant generation), and publish your content solely as required to provide the Service. This license also lets the Company show other Buzzfy users, through Reel Search, a link to your published Reels, their public counts, information derived from them and a rating of their opening, unless you opt out as described in our Privacy Policy. This license terminates when you delete the relevant content or your account, except for content already published to Instagram.

The Buzzfy platform, software, and any AI models or systems used to provide the Service are owned by the Company. Nothing in these Terms transfers ownership of any such intellectual property to you.

10. Free Trial Branding

Trial Reels published during your free trial period may include a mention of or tag to Buzzfy's Instagram account (e.g., @buzzfy.co) in the caption. This branding is removed from future Trial Reels once you become a paying subscriber. Previously published Trial Reels are not modified retroactively.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS LIMITS RIGHTS YOU HAVE AS A CONSUMER THAT CANNOT BE EXCLUDED BY CONTRACT.

We do not guarantee that the Service will achieve any specific results (e.g., follower growth, increased views). Instagram's algorithms and policies are outside our control and may change at any time. We are not responsible for the outputs or actions of third-party AI apps you connect to the Service (Section 5.5).

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER THE COMPANY NOR THE AUTHORISED RESELLER SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

The total aggregate liability of the Company and the Authorised Reseller, taken together, for any claims arising under these Terms shall not exceed the amount you paid for the Service in the 12 months preceding the claim. This section does not limit liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot be limited by law.

13. Indemnification

You agree to indemnify and hold harmless the Company, the Authorised Reseller, and their respective officers, employees, and agents from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of the Service (including actions taken through an AI app you connected and actions you approved), your violation of these Terms, or your violation of any third-party rights (including Instagram's terms), to the extent permitted by law.

14. Termination

We reserve the right to suspend or terminate your account if you violate these Terms or if we reasonably believe your use poses a risk to the Service or other users. You may delete your account at any time from your account settings. We may also suspend or restrict access to the MCP alone, as described in Section 5.7.

Upon termination, your right to use the Service ceases immediately. Sections 1, 5.5, 9, 11, 12, 13, 16 and 17 survive termination.

15. Changes to the Service and Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice on the Service at least 30 days before they take effect for existing subscribers. If you do not agree, you may cancel before the change takes effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

16. Service Provider and Seller

These Terms are entered into between the person using the Service (the "User" or "you") and Otto Apps Yazılım Uygulama Bilgi Teknoloji Reklamcılık Danışmanlık Sanayi ve Ticaret A.Ş., a company incorporated in Türkiye with its registered address at İçerenköy Mah. Topçu İbrahim Sk. Quick Tower No:8-10D, Ataşehir / İstanbul, Türkiye (the "Company", "we", "us" or "our"). The Company develops, operates and provides Buzzfy and is responsible to the User for the Service, the User's account, personal data and support (contact: support@buzzfy.co).

Purchases made on buzzfy.co and its checkout pages are sold to the User by Alvin AI Studio LLC, 447 Broadway, 2nd Floor Suite 3007, New York, NY 10013, USA (the "Authorised Reseller"), acting as merchant of record solely to process payment, issue receipts, collect applicable taxes and handle payment-side refunds and chargebacks. Where these Terms refer to the Company charging, billing or refunding a web purchase, this is performed by the Authorised Reseller. Alvin AI Studio LLC is the name that appears on your card statement.

Where any other provision of these Terms describes the Authorised Reseller, a merchant of record or any other company as the "Company", "we", "us", "our", the contracting party or the provider of the Service, refers to a seller other than the Authorised Reseller, or describes the Company only as a technical provider, developer, licensor or processor that is not a party to these Terms, this section prevails and these Terms shall be construed accordingly. Nothing in this section limits any statutory right of the User.

For subscriptions started before this update, this section applies from the first renewal falling at least 30 days after notice to the User; the price, plan and billing of such subscriptions do not change.

17. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Istanbul (Çağlayan) have jurisdiction over any dispute arising out of or in connection with these Terms. This does not deprive a User who is a consumer of the protection of the mandatory provisions of the law of the User's country of residence, including any right to bring proceedings before the courts of that country. Any other provision of these Terms providing for a different governing law, different courts or arbitration is replaced by this paragraph.
